1. Introduction

Welcome to Mass Image Compressor (“the App”), an application owned and operated by Cognirush Labs LLP (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the App, including any related services, content, or features we provide. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the App.

This agreement is legally binding, so we advise you to read it carefully.

2. License to Use

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to use the App solely for your personal or business purposes on macOS 12 or higher. You may not:

  • Use the App for any illegal or unauthorized purposes.
  • Modify, reverse-engineer, or decompile any part of the App.
  • Resell, sublicense, or redistribute the App or any part of it without our written permission.

The App is provided solely for image and video compression purposes. You must ensure that your use complies with all applicable laws and regulations.

3. Supported Operating Systems

The App is designed to operate on macOS versions 12 and above. While we strive to ensure compatibility across macOS versions, some features may be limited or unavailable on macOS 12 and 13 due to backward compatibility constraints:

  • macOS 12 & 13: Some features, especially those related to look and feel (e.g., compression progress charts), may not be fully available. However, these limitations do not affect the core functionality of the App.
  • macOS 14 and above: Users on these versions can access the full set of features, including Apple’s new subscription UI for in-app purchases.

Future Compatibility Disclaimer:
We do not guarantee that the App will remain fully compatible with future versions of macOS. As Apple releases new macOS updates, certain features or functionalities of the App may be affected, and we may require time to adapt to such changes. Users are encouraged to check our website or support resources for compatibility updates.

4. Subscription Plans and Free Trial

We offer both a free version and subscription-based access to premium features. Subscriptions are processed through Apple’s in-app purchase infrastructure, which handles billing, renewals, and cancellations. You must have an active App Store account to subscribe.

4.1(a) Subscription Options:

  • Standard Subscription (Monthly or Yearly): This provides premium features such as removing MIC software’s watermarks, modifying output file names,  and controlling EXIF metadata in compressed images. The subscription plan is available in two billing cycles but Yearly cycle opens up occasionally:
    • Monthly Subscription
    • Yearly Subscription (occasionally on sale)
  • Pro Subscription (Monthly or Yearly): In addition to options provided by ‘Standard Subscription’, this provides premium features such as contextual keyboard shortcuts, file selection filters and options to resize image for common print sizes and DPI. The subscription plan is available in two billing cycles:
    • Monthly Subscription
    • Yearly Subscription

Yearly and Monthly plans offer the same features, with differences only in pricing and any promotional offers.

4.1(b) Perpetual Purchase Option – Pro (Lifetime) :

  1. This purchase is a non-consumable one-time payment granting the user all features of the Pro Subscription for as long as the application is supported.
  2. Upon purchasing Pro (Lifetime), users must manually cancel any existing auto-renewing subscriptions, as the application does not support automated cancellation.
  3. Existing subscriptions will no longer provide additional value post-purchase of Pro (Lifetime).
  4. No refunds will be issued for auto-renewals not cancelled by the user.
  5. The application may provide reminders to assist users with cancelling such subscriptions. However, these reminders do not guarantee compliance.

4.2 Free Trial:

  • New users are eligible for a one-week free trial of the Standard or Pro subscription plan. The trial can only be availed once per user and cannot be reinstated if canceled. If you do not cancel during the free trial period, your subscription will automatically renew at the current rate. Free trials are subject to change, and any modifications to the offer will not apply retroactively.

4.3 Auto-Renewal and Cancellation:

  • Subscriptions automatically renew at the end of the billing cycle unless canceled. You will be charged at the then-current rate. To avoid being charged for the next cycle, you must cancel before the renewal date.
  • Cancellation must be managed through your Apple App Store account under subscription settings. The App does not provide an in-app option for cancellation.
  • Family Sharing: Subscriptions cannot be canceled by family members via Family Sharing. Only the original purchaser can manage the subscription.

4.4 Apple’s Role in Subscription Management:

As subscriptions, including billing, renewals, and cancellations, are managed through Apple’s in-app purchase infrastructure, Cognirush Labs LLP has no control over these processes. Any disputes or issues related to subscription billing, renewal, or cancellation should be directed to Apple Support. However, if you experience issues with the App, such as not being able to access subscribed features, you should report the issue to Cognirush Labs LLP at support@cognirush.com.

4.5 Price Changes

We reserve the right to modify subscription prices at any time. Any price change will be handled by Apple’s in-app purchase system, and you will be notified by Apple regarding any changes in subscription pricing before the changes are applied to your account.

Please note that Mass Image Compressor may not display in-app notifications about subscription price increases. Apple is responsible for communicating these changes, and they will typically send an email or notification via your Apple account. If you do not agree with the new price, you may cancel your subscription before the next billing cycle by managing your subscription in your App Store account settings.

5. Limitations of Free Version

  1. No Limit on Usage: The free version of the App does not limit the number of images you can compress. 
  2. Watermark: For images with resolutions exceeding 1080 pixels in width or height after compression, a small watermark will be added. This watermark includes the app’s name, “Mass Image Compressor,” and appears at the bottom-right corner of the image. The watermark is essentially a small overlay image and may vary slightly in appearance depending on the input image. We reserve the right to modify the watermark’s design as needed. We make every effort to avoid applying a watermark during replace operations (e.g. when user uses ‘Replace All’ in output setting); however, we cannot guarantee the exclusion of watermarks in such cases.
    • This restriction may or may not apply to you for software version that you are using.
  3. Maximum One Watermark per Session: Mass Image Compressor will apply watermark to only one  image from mostly largest among initially added images. You will be able to see this indicated in Gallery View of Mass Image Compressor. New session will begin when you reopen Mass Image Compressor

Missing Features:
Beyond the watermarking feature, certain advanced functionalities are available exclusively to subscribers. These include features such as custom watermark options, keyboard shortcuts, predefined print-size shortcuts, and other premium enhancements.

These additional features are optional and do not restrict the functionality of the free version. The core compression and processing capabilities remain fully accessible to all users without limitations, with the exception of the watermark feature.

  1. Custom Watermark: Users with Pro Subscription can conditionally apply their choice of watermark on compressed images, this feature is not available in Free Version.
  2. Keyboard Shortcuts: The App provides Contextual Keyboard Shortcuts for few existing buttons on the App. These Keyboard Shortcuts are NOT available for Free Version.
  3. Dimension Resize Options for Print: The App provides options to resize the images for printing and storing high DPI information in metadata for those images. These ‘For Print’ resize options are NOT available for Free Version.
  4. File Selection Filters: File selection filters allow you to include or exclude file based on one or more parameters. These parameters may be file name patterns, last modified date and file size on disk. This feature is only available to ‘Pro Subscription’ users and not to Free Version.
  5. Video Compression: Video compression is available as free feature only till the feature is in experimental phase. 

Users are free to remove the watermark or EXIF comments added by the App using third-party tools or methods. However, you must not modify, alter, or reverse-engineer the software to remove these elements, as paid subscription options are available within the App to remove the watermark and EXIF comment tag legitimately.

Additionally, you are prohibited from integrating the App into automated pipelines or workflows that aim to systematically remove watermarks or EXIF metadata without subscribing to the appropriate subscription plan. Violating this restriction is considered a breach of these Terms.

Example of Valid Use:

To clarify further, if you use an image editing tool like  Photoshop to manually remove the watermark or EXIF comment from an individual image, this is permitted.

Example of Violation:

An example of a violation would be setting up a file watcher that automatically monitors the output folder where compressed images are saved and runs a script or automated process to systematically remove the watermark and EXIF metadata from all images, without subscribing to the Standard Subscription or Pro Subscription plan. This would breach these Terms as it bypasses the intended limitations of the free version.

6. Image/Video Compression and Metadata Management

The App allows you to compress images/videos by reducing their size or changing formats. Users have the ability to:

  • Compression Options: Resize images/videos by adjusting the dimensions or reducing quality.
  • Format Conversion: Convert images between various formats (e.g., PNG to JPG, JPG to HEIC).
  • Only MP4 and MOV videos are supported as input and videos will be converted to only MP4 i.e. MOV videos also will be converted to MP4.

6.1 Input Image Formats:

The App supports many common image formats but does not support all formats:

  • Unsupported Formats: The App does not support reading or compressing SVG or PDF or ICO files.
  • Raw Camera Formats: We support most but not all raw camera formats. While we strive to support as many raw camera formats as possible, the App is reliant on underlying libraries from the operating system. As such, the level of support for different raw image formats may vary across macOS versions.
    • We have tested the App with raw images from the following camera models, and they have worked in formats such as .nef, .dng, .cr2, .cr3, .raf, .rw2, and .arw:

    • However, despite our best efforts, we cannot guarantee that all raw files from tested models or formats will work for every user. For example, as of December 12th, 2024, we are encountering issues with raw images in the .nef format from Fujifilm-GFX-50SFujifilm-X100F, and Fujifilm-XH1.
  • Important Notice: Purchasing a subscription to Mass Image Compressor will not resolve any issues related to unsupported or problematic raw image formats. We strongly recommend that you test your intended images using the free version or during the free trial period before making a purchase.
  • By using the App, you acknowledge that we are not liable for any compatibility issues, and that future updates to the macOS operating system may affect compatibility, which is outside of our control.

6.2 Output Images & Formats:

The App allows you to retain the same image format for compressed images. However:

  • Fallback to JPG: If the selected image format is unsupported as an output format, the App will automatically default to JPG as the output format.
  • The App clearly lists the available output formats in the compression settings menu, allowing you to select from supported formats.

6.3 Metadata Copying:

The App provides options to transfer metadata from the original image to the compressed version. These options include:

  • Copying all metadata.
  • Copying metadata without sensitive information (e.g., location data).
  • Not copying any metadata at all.

While we make efforts to transfer all EXIF metadata, certain non-standard or proprietary metadata may not be copied. You are responsible for verifying that sensitive metadata has been removed if the “All But Sensitive” option is selected.

Copying Metadata to WebP images are not supported. 

IPTC Metadata Transfer:
The App copies IPTC (International Press Telecommunications Council) metadata from the source image to the compressed image when the “All But Sensitive” metadata option is selected. IPTC metadata may contain detailed information such as copyright details, author information, and other source data.

If you select the metadata options “None” or “Only Compression Info,” the App will remove all IPTC metadata from the compressed image, ensuring that no IPTC details are retained.

By using these options, you acknowledge and agree to the handling of IPTC metadata as described above.

6.4 Compression Guarantee Disclaimer

We do not guarantee that all images/videos will be compressed. Some images/videos may already be in a highly compressed format and cannot be further compressed. If no changes are made to the image/videos dimensions or output format, the App will attempt to retain the original image and mark it as compressed, showing 0% reduction in size. In some cases, such as converting from a more compressed format (e.g., HEIC) to a less compressed format (e.g., PNG), the output image may be larger in size. Despite the increase in disk size, the App will convert the image as per your request.

6.5 Additional Notes on Video Compression

  1. Supported Formats: The application supports compression of MP4 and MOV video formats into an MP4 container.
  2. Frame Rate Adjustment: Videos with frame rates exceeding 50 FPS may have their frame rate reduced to half to optimize compression and size.
  3. Audio and Video Tracks: Multi-tracked audio and videos are not supported. Such videos will not be processed for compression.
  4. Subtitles: Embedded subtitles are not retained in the compressed video. Videos will be compressed, but any subtitles present in the original will be excluded.

7. Data Loss and User Responsibility

While the App attempts to warn users of potential overwrites, we cannot guarantee the detection of all situations where data loss may occur. You should follow these guidelines to avoid losing important files:

  • Input vs. Output Locations: Ensure that the output directory is different from the input directory to avoid overwriting original files.
  • Overwriting Existing Files: If the output directory contains files with the same names as the input files, the App will overwrite these without further warnings. You are responsible for ensuring no essential files are lost.
  • Application provides option to overwrite input file, which must be used with caution and user must keep backup of original images when the App is used to overwrite the input images.

To safeguard your data, we recommend using an empty output directory for all compressed files.

8. Limitations of Liability

The App is provided “as is,” and we make no representations or warranties of any kind, whether express or implied, about the performance, quality, or suitability of the App for any specific purpose.

To the maximum extent permitted by law, we disclaim all warranties, including those related to the App’s fitness for a particular purpose or non-infringement. We are not liable for any damages resulting from your use of the App, including:

  • Data loss due to overwritten files.
  • Downtime or inability to access the App.
  • Any consequential, incidental, or indirect damages.

9. Modifications and Updates

We reserve the right to modify or update the App at any time. These updates may include:

  • Bug fixes.
  • Performance improvements.
  • New or enhanced features.

In some cases, you may need to update your macOS to access new features. We are not responsible for any lack of compatibility resulting from failure to update.

10. Intellectual Property

All intellectual property rights in the App, including but not limited to text, graphics, software code, trademarks, and logos, are the property of Cognirush Labs LLP or its licensors. You agree not to:

  • Copy, modify, or create derivative works from the App.
  • Use any trademarks, logos, or trade names associated with the App without prior written consent.

The App logo and name (“Mass Image Compressor”) may not be used in any manner that could cause confusion, disparage the App, or falsely imply an endorsement by us.

10.1 Apple Trademarks:

The terms “Apple”, “App Store,” “macOS,” and any other trademarks referenced within the App or related materials are trademarks of Apple Inc. Use of these trademarks does not imply any affiliation with or endorsement by Apple Inc.

10.2 Camera Make and Model

All camera makes and models mentioned within the App, including but not limited to Nikon, Canon, Fujifilm, Sony, and others, are trademarks of their respective organizations. The inclusion of these makes and models in the App does not imply any affiliation with or endorsement by these organizations.

11. Termination

We may terminate or suspend your access to the App if we reasonably believe that you have violated any of these Terms. In such cases, you must immediately cease all use of the App. Upon termination, your license to use the App will be revoked, and we will have no further obligation to provide access to any App-related services.

12. Governing Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with the use of the App will be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

13. Support and User Submissions

  1. Feedback and Suggestions:If you provide any suggestions, ideas, feedback, or other information regarding the App (“User Submissions”) to Cognirush Labs LLP, you acknowledge that:
    • Cognirush Labs LLP is free to use, disclose, reproduce, modify, and distribute these submissions for any purpose, without restriction and without any obligation to provide compensation, credit, or attribution to you.
    • You have no ownership rights or claims over any enhancements, modifications, or improvements made to the App based on your submissions. All rights to implement or incorporate your suggestions are exclusively owned by Cognirush Labs LLP.
  2. Confidentiality and Disclosure: While we strive to maintain the confidentiality of your submissions, we reserve the right to disclose user-provided information:
    • To regulatory bodies or authorities, if required by law or to comply with regulatory requirements.
    • For the purpose of protecting our reputation, intellectual property, or legal interests.
  3. Sample Images/Videos or any other asset along with troubleshooting data and logs: If you submit any sample images/videos/logs or data to our support team for troubleshooting purposes, we may retain them in our test database to improve our services. However, upon receiving an explicit request via email containing the exact picture to be deleted, we will remove such data from our database.

By contacting our support team or submitting any feedback, suggestions, or troubleshooting materials, you agree to these terms.

15. Changes to These Terms

We reserve the right to change or update these Terms at any time. If changes are made, they will be posted on our website or within the App, and it is your responsibility to review these Terms periodically. Continued use of the App after any changes constitutes acceptance of the revised Terms.
